These Terms & Conditions (“Terms”) govern all purchases, registrations, and participation related to events produced or operated by Sport Air Racing Council (“SARC”), including SkyFiesta of Las Cruces (“SkyFiesta,” “the Event,” “we,” “us,” or “our”).

By purchasing tickets or merchandise, registering as a participant, vendor, sponsor, or otherwise engaging in a transaction with SARC or SkyFiesta, you agree to these Terms.
 

1. Scope of These Terms

   1. These Terms apply to, but are not limited to:

      • Event tickets

      • Racer registrations

      • Vendor and exhibitor fees

      • Sponsorships

      • Camping, fly-in, and related event fees

      • Merchandise or other event-related purchases

   2. Additional rules, procedures, or operational requirements may apply to specific activities and are incorporated by reference.
       

2. Refund, Cancellations & Transfers

   1. All purchases are subject to SARC and SkyFiesta’s Refund Policy, which is incorporated into these Terms by reference.

   3. Refund eligibility, deadlines, administrative fees, and exceptions (including those related to weather, safety, or operational conditions) are governed exclusively by the Refund Policy.
       

3. Event Changes, Delays or Cancellation

   1. SkyFiesta is an aviation-related outdoor event and is subject to conditions beyond our control, including but not limited to:

      • Weather

      • Safety considerations

      • FAA or airport restrictions

      • Performer or participant availability

      • Operational or logistical requirements

   2. We reserve the right to modify schedules, programming, locations, or event elements at any time. Such changes do not automatically entitle purchasers to refunds unless expressly stated in the Refund Policy.
       

4. Assumption of Risk

   1. Attendance at or participation in aviation events involves inherent risks.

   2. By attending or participating, you voluntarily assume all risks associated with:

      • Aircraft operations

      • Air racing activities

      • Airshows and demonstrations

      • Ground operations

      • Crowds and outdoor conditions

   3. You agree that SARC and SkyFiesta are not responsible for injury, loss, damage, or delay except as required by law.
       

5. Participant & Racer Responsibilities

   1. Participants, including racers, pilots, vendors, and exhibitors, agree to:

      • Comply with all applicable FAA regulations

      • Follow airport rules, event procedures, and safety directives

      • Maintain required licenses, certifications, insurance, and documentation

      • Conduct themselves in a professional and cooperative manner

   2. Failure to comply may result in removal from the event without refund.
       

6. Payment & Chargebacks

   1. By completing a purchase, you authorize SARC or SkyFiesta to charge the provided payment method.

   2. You agree not to initiate chargebacks or payment disputes without first contacting SARC to attempt resolution. Unauthorized or unjustified chargebacks may result in:

      • Revocation of event credentials or participation privileges

      • Denial of future registrations or attendance
         

7. No Transfer of Rights

   1. Purchases and registrations are non-transferable unless explicitly allowed in writing by SARC or stated in the applicable Refund Policy.
       

8. Limitation of Liability

   1. To the fullest extent permitted by law, SARC and SkyFiesta shall not be liable for:

      • Indirect, incidental, or consequential damages

      • Lost profits or business opportunities

      • Travel costs or related expenses

   2. Our total liability shall not exceed the amount paid for the specific transaction giving rise to the claim.
       

9. Photo, Video & Medial Release

   1. By attending, participating in, or otherwise engaging in any SARC or SkyFiesta event or activity, you grant Sport Air Racing Council (“SARC”) and SkyFiesta of Las Cruces, and their agents, contractors, partners, sponsors, and designees, the irrevocable right to capture, use, reproduce, publish, distribute, and display your name, likeness, image, voice, appearance, and any photographic, audio, or video recordings in which you may appear.

   2. This permission applies to all media formats, whether now known or later developed, including but not limited to:

      • Websites and social media

      • Marketing, advertising, and promotional materials

      • Broadcast, streaming, and documentary content

      • Educational, archival, and historical uses

   3. You acknowledge and agree that:

      • Such media may be used without further notice, review or approval

      • No compensation will be provided for the use of such media

      • All rights, titles, and interest in such media belong to SARC or its designees

      • Media may be edited, combined with other content, or used in whole or in part

   4. This release applies worldwide and in perpetuity, to the fullest extent permitted by law.  This media release survives the conclusion of the event and termination of these Terms.

   5. If you do not wish to be recorded, your sole remedy is to refrain from attending or participating in the event or to avoid areas where media capture is taking place.
       

10. Governing Law

    1. These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law principles.
        

11. Modifications to These Terms

    1. We may update these Terms from time to time. The version posted on our website at the time of purchase governs that transaction.
